1. Who We Are

Borneo History Archive is operated by the North Borneo History Research Centre (NBHRC). We are building a public digital archive of Borneo's historical newspapers, colonial records, and documents. Our website is located at borneohistory.com. You can contact us at admin@borneohistory.com.

2. Acceptance of Terms

By accessing or using borneohistory.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. We may update these terms from time to time; continued use of the Site after changes are posted constitutes your acceptance of the revised terms.

3. Use of the Site

You may use the Site for personal, non-commercial research and educational purposes. You agree not to:

• Reproduce, distribute, or republish our original content (transcriptions, commentary, curated collections) without written permission
• Use automated tools to scrape or bulk-download content without prior consent
• Attempt to gain unauthorised access to any part of the Site or its infrastructure
• Use the Site in any way that violates applicable laws

4. Membership

We offer free and paid membership tiers. By registering as a member, you agree to provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.

Paid memberships are billed on a recurring basis (monthly or annual). You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; we do not offer prorated refunds for partial periods unless required by law. If you believe you have been charged in error, contact us within 30 days.

5. Email Communications

By creating an account or subscribing to our newsletter, you consent to receive transactional emails (account confirmation, magic links) and, where you have opted in, newsletter and editorial emails. You may unsubscribe at any time using the link in any email or by updating your account preferences. We use Mailgun to deliver email; your address is processed in accordance with our Privacy Policy.

6. Intellectual Property

Historical primary source materials reproduced on this Site (newspaper scans, government records, photographs) are in the public domain or used under applicable fair dealing provisions. Our original work — including transcriptions, editorial commentary, and curated collections — is copyright © North Borneo History Research Centre. All rights reserved.

If you wish to cite or reproduce our original work, please credit "Borneo History Archive, borneohistory.com" and contact us for commercial use.

7. Accuracy Disclaimer

Historical content on this Site may contain errors, omissions, or outdated information reflecting the views and language of earlier eras. We strive for accuracy but cannot guarantee that all transcriptions or interpretations are free from error. Content is provided for research and educational purposes only and should not be relied upon as a definitive historical record without independent verification.

8. Limitation of Liability

To the fullest extent permitted by law, NBHRC and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content. The Site is provided "as is" without warranties of any kind.

9. Governing Law

These terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
